           The bill, called the “Inflation Reduction Act of 2022” (HR 5376), plans to tackle US debt and inflation issues along with the current climate crisis and could pass the Senate this week if all goes well. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;

           , but Section 13204 on page 315, titled “Clean Hydrogen,” outlines the most significant clean hydrogen investment in U.S. history.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;span&gt;&#xD;
      
           $3/kl tax credit puts Washington in a leadership position
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The hydrogen section of the bill provides the basis to build a national hydrogen production ecosystem and the benefits accrue to states like Washington that already have a cost advantage and clean electricity advantage over other regions in the U.S. For example, credit generation for companies producing hydrogen will be authorized for ten years, taking effect when a facility was placed in service and provides a $0.60/kilogram credit on a sliding scale based on the carbon intensity (CI) score of the hydrogen produced. The lowest carbon intense (CI) H2 receives the max $0.60 credit. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Below you will find how these percentages vary based on the lifecycle of greenhouse gas (GHG) emissions. The bill’s provisions outline the percentage of credit based on the CI of hydrogen. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If lifecycle GHG is between 2.5 and 4 KG (inclusive of 2.5 and 4 KG), the applicable percentage is 20%
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If lifecycle GHG is between 1.5 and 2.5 KG (inclusive of 1.5 KG) applicable percentage is 25%
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If lifecycle GHG is between .45 and 1.5 KG (inclusive of .45 KG) applicable percentage is 33.4%
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If lifecycle GHG is below .45 KG, the applicable percentage is 100%
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Putting this into action, a company that produces 100,000 KG of H2 in a year and emits 2 KG of GHG gives that company credit of 100,000 X .25 ($0.60), equaling $15,000. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           To account for future inflation risks, there will be an adjustment to the $0.60 credit in which the amount ($0.60) is multiplied by the inflation adjustment factor for the year the qualified clean hydrogen is produced. If any amount increased is not a multiple of 0.1 cents, the amount will be rounded to the nearest multiple of 0.1 cents.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;span&gt;&#xD;
      
           5X Multiplier Credit For Green Hydrogen 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Another incentive offered in the bill gives companies a bonus credit five times the base credit ($0.60) to produce clean hydrogen that is not greater than 4 KG of CO2e per KG of hydrogen. This credit will not be available to a hydrogen production facility utilizing carbon sequestration to gain credits under the tax incentive 45Q to prevent facilities from “double dipping.”
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Facilities looking to capitalize on this bonus credit must meet the requirements below.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            H2 must be produced in the U.S. for sale, use, or ordinary course of a trade or business
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Project construction needs to begin before the date that is 
           &#xD;
      &lt;/span&gt;&#xD;
      &lt;a href="/site/ec62c4a7null?preview=true&amp;amp;nee=true&amp;amp;showOriginal=true&amp;amp;dm_checkSync=1&amp;amp;dm_try_mode=true&amp;amp;preview=true&amp;amp;nee=true&amp;amp;showOriginal=true&amp;amp;dm_checkSync=1&amp;amp;dm_try_mode=true&amp;amp;dm_device=desktop" target="_blank"&gt;&#xD;
        
            60 days
           &#xD;
      &lt;/a&gt;&#xD;
      &lt;span&gt;&#xD;
        
             after the Secretary publishes guidance regarding prevailing wage and apprenticeship guidance 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Ensure laborers and mechanics hired by contractors for the construction or alteration and repair of the facility be paid prevailing rates or higher while also ensuring the prescribed percent of construction is performed by “qualified apprentices."
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Renewable Energy Used To Produce Green Hydrogen Qualifies
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Other energy production facilities may have questions regarding their applicability for acquiring their own credits. The bill states that a facility producing electricity through the process of renewable resources qualifies for recognition if the facility uses the electricity to contribute to producing clean hydrogen. This will be verified by an unrelated third party prescribed by the Secretary of Energy and will apply to electricity produced after December 31, 2022. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Election to Treat Clean Hydrogen Production Facilities as Energy Property
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           If a facility is designed and expected to produce qualified clean hydrogen within reason, that qualified property will be treated as energy properties. The energy percentage these properties are expected to produce is also based on the lifecycle GHG emission rates mentioned earlier, which you can find below. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If lifecycle GHG is between 2. 5 and 4 KG (inclusive of 2.5 &amp;amp; 4 KG), the applicable percentage is 1.2%
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If the lifecycle GHG is between 1.5 and 2.5 (inclusive of 1.5 KG), the applicable percentage is 1.5%
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If the lifecycle GHG is between .45 and 1.5 KG (inclusive of .45 KG), the applicable percentage is 2%
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            If lifecycle GHG is below .45 KG, the applicable percentage is 6%
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The “Inflation Reduction Act” is an excellent indicator of what will transpire for clean hydrogen producers. If this bill passes the Senate, we are hopeful that the enormous impacts of a bill will help the U.S. to lead the world in addressing the impacts of climate change and to be a positive example for the rest of the world to take action

           Welcome to the first-ever Washington Green Hydrogen Alliance (WGHA) newsletter. As I write this, there is cause for celebration: The first four months of this year brought some big wins for Washington-made green hydrogen and saw the WGHA secure some of our major priorities - steps that will grow Washington State’s green hydrogen economy, create union jobs and help families and businesses benefit from an affordable, Washington-made, zero-carbon fuel source. Those steps include:

    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Passing bipartisan legislation, 
           &#xD;
      &lt;/span&gt;&#xD;
      &lt;a href="https://app.leg.wa.gov/billsummary?BillNumber=5910&amp;amp;Year=2021&amp;amp;Initiative=false" target="_blank"&gt;&#xD;
        
            SB 5910
           &#xD;
      &lt;/a&gt;&#xD;
      &lt;span&gt;&#xD;
        
             and seeing it signed into law was a major WGHA legislative priority. The legislation will accelerate the availability and use of green hydrogen in the state by, among other key provisions, providing substantial tax exemptions for green electrolytic hydrogen and authorizing municipal utilities and public utility districts to produce, use, sell, and distribute green electrolytic hydrogen. We’re grateful to Senators Carlyle and Hawkins for their bipartisan sponsorship of the legislation and want to thank Representatives Ramel, Abbarno, Dye, and Orcutt for bipartisan support of the bill through the House. We’re grateful to Governor Inslee for signing this legislation into law. I also want to say a special thank you to Dave Warren, WGHA’s Legislative Director, and the entire team at WGHA for their tireless work and expertise that was invaluable in shaping this legislation.

            The state’s new Office of Renewable Fuels. Our priority legislation also established the state’s first-ever Office of Renewable Fuels and invests $1.1 million to build Washington’s renewable fuels leadership.

  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;

            Securing $2 million to support the state's role in competing for a $2 billion federal grant from the Department of Energy to develop a regional clean hydrogen hub. The competition will be fierce among the states to be awarded the regional hydrogen hub. States will be awarded the federal money to establish a hydrogen ecosystem that leverages a state's most abundant resources, in Washington’s case, renewable electricity, to build the infrastructure to produce hydrogen as an alternative fuel used in heavy-duty industries and industrial processes, aviation, and transportation. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/li&gt;&#xD;
  &lt;/ul&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;ul&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            The bipartisan Hydrogen Caucus in the House of Representatives. This new caucus in Olympia will be taking shape over the interim under the leadership of Representatives David Hackney (D-Tukwila) and Peter Abbarno (R-Centralia). We thank them for agreeing to Co-Chair the newly-formed bipartisan Hydrogen Caucus in the House of Representatives.

The steps taken by the Legislature will grow Washington State’s green hydrogen economy, and help families and businesses benefit from an affordable, Washington-made, zero-carbon fuel source.

           Over the last 60 days, House and Senate members acted to:

The legislation, which was approved in a 49-0 vote in the Senate on February 12 and then by a 96-2 vote in the House on March 7, followed by a unanimous concurrence vote in the Senate on March 9, will accelerate the availability and use of evergreen hydrogen in the use of state by, among other key provisions, authorizing municipal utilities and public utility districts to produce, use, sell, and distribute green hydrogen.

           SB 5910
          &#xD;

           , legislation that would grow Washington State’s green hydrogen economy, and help families and and businesses benefit from an affordable, Washington-made, zero-carbon fuel source. The legislation was approved in a 49-0 vote in the Senate on February 12 and then by a 96-2 vote in the House on March 7, followed by a unanimous concurrence vote in the Senate on March 9.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The legislation would accelerate the availability and use of (Ever)green hydrogen by:
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●      Authorizing municipal utilities and public utility districts to produce, use, sell, and distribute renewable and green electrolytic hydrogen (together both terms describe types of non-fossil fuel based hydrogen);
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●      Establishing the statewide Office of Renewable Fuels; 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●      Extending sales and use and leasehold excise tax exemptions for green electrolytic hydrogen to those exemptions already provided to renewable hydrogen;
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●      Authorizing the director of the Department of Commerce to support an application by a public private partnership entity for federal funding, potentially up to $1 billion, to develop a regional clean hydrogen hub.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●      Requiring consultation with federally recognized Tribes and include communities across the state, including overburdened communities, in the Hydrogen Hub application process; and,
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●      Requesting consultation with the Washington State Association of Fire Marshals regarding fire and other safety standards adopted by the United States Department of Energy and recognized national and international fire and safety code development authorities regarding renewable fuels and green electrolytic hydrogen.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
            
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           “The strong, bipartisan support for this legislation shows our leaders recognize the opportunity for our climate, air, water, and economy with evergreen hydrogen made right here in Washington. It also shows the broad support in Olympia for a state focus on collaborative public-private partnership in the competition to be a regional clean energy hub under the U.S. Department of Energy,”

          The Port of Chehalis Commission on Thursday unanimously approved a motion to allow CEO Randy Mueller to enter into a memorandum of understanding (MOU) with Twin Transit to eventually construct a hydrogen fuel station on its property. 
         &#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The non-legally binding agreement further paves a path forward to establish the state’s first hydrogen fuel station in Lewis County, and to open up opportunities for further development of alternative fuel opportunities.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
